Definitions.
The Pennsylvania Code (Title 18, Chapter 27, Section 2702) treats aggravated assault as follows: the accused may face first or second degree felony charges for this offense, in the following circumstances:

Aggravated assault (felony of the first degree): attempting to cause serious bodily injury to another or causing serious injury under circumstances where the defendant displayed an extreme indifference to human life. Attempting to cause or causing serious bodily injury to any police office (including non-patrol people), firefighter, judge, district attorney, public defender, sheriff or other peace officer or employee. If found guilty, these charges carry up to 20 years in prison.

Aggravated assault (felony of the second degree): attempting to cause or causing injury or fear of serious bodily injury to any peace officer or related employee, or any teacher or school board member or employee. Using tear gas, a Taser, or other electroshock weapon against a peace officer or employee. Attempting to cause or causing physical injury to another with a deadly weapon. This offense is punishable by up to 10 years in prison.
